The Chinese Section of the Canton-Kowloon
Railway is mortgaged to the British-Chinese Corporation
as security for the loan for the construction of the
railway. This loan has not yet been refunded, and,
while any part of this loan is outstanding, the railway,
while remaining the property of the Chinese Government,
is still under mortgage to the Corporation, whose rights
are defined by the Canton-Kowloon Railway loan agreement
made at Peking on March 7th, 1907. At the same time,
the Chinese Government is bound to protect the railway,
and see that it does not deteriorate in any way as
security against the constriction loan.

Attention in
Ambassador has instructed me to protect immediately
against any destruction of the property of this railway,
or interference with its operation. A similar protest
has been lodged by His Majesty's Ambassador with the
Central Government.

This protest is lodged in consequence of a
report received by the Engineer-in-Chief of the railway
to the effect that soldiers have been sent to the various
stations on the railway to destroy railway property in
case of emergency when threatened with enemy occupation.
